Know Your Rights

YOU HAVE THE RIGHT TO REMAIN SILENT.
If a police officer questions you, you have the right to decline to answer questions.  If a police officer asks you questions, you should consider calling a lawyer.  The attorneys a BJA are here to help. 

YOU HAVE THE RIGHT TO COUNSEL.
The criminal justice system is complicated and your freedom may be on the line.  You have the right to speak with a well qualified lawyer.  If you cannot afford to hire an attorney the courts will appoint one for you.

YOU HAVE THE RIGHT TO A FAIR AND SPEEDY TRIAL.
You have the right to have your case hear within 180 days of your arrest (90 days for misdemeanors).  You can shorten this time to 50 days if you so choose by making the appropriate demand.  In this way you can resolve your case quickly and efficiently rather than being left uncertain, or in jail, for months or even years on end.

YOU HAVE THE RIGHT TO CONFRONT WITNESSES.
You have the right to cross-examine, or to have your attorney cross-examine, witnesses on your behalf.  In this way, you may ask questions of those testifying against you.  In this way you can point out any inconsistency or improper motive they may have. 

YOU HAVE THE RIGHT TO APPEAL.
Neither judges nor the jury are infallible.  If a mistake has been made during your trial you have the right to ask a higher court to intervene.  The Attorneys of BJA have experience taking their cases to the appellate courts on behalf of their clients.
